Position: Executive Vice President & Managing Director, General Counsel, Member of the Leadership Team
Location: Washington, D.C. and New York, N.Y.
Reports to: President & CEO
Key Relationships: Works directly with the President & CEO, Government Relations team, and International Affairs team on leading various legislative and regulatory initiatives.
Position Description: As the leading global trade association for the hedge fund and managed futures industry, Managed Funds Association plays a critical role in educating and informing policymakers and key constituencies about the valuable role the industry plays in the capital markets. The key stakeholders with whom the Association interacts include hedge fund manager members, industry partners, media, policymakers (U.S. and EU), and existing and potential industry investors, among others.
The Executive Vice President, General Counsel will lead and direct the legal department, including working directly with the President & CEO on strategic planning of the organization’s yearly regulatory priorities. The General Counsel will lead MFA relating to various public policy initiatives before federal and state agencies, including the SEC, the CFTC, Treasury and the Federal Reserve Board. This position will help lead MFA committees to develop and reach consensus on complex public policy issues. In addition, this position coordinates with the CEO and finance team on the annual legal operating budget to determine the administrative, personnel and legal resources needed, and to manage that budget to deliver the most effective service to membership.
Job Responsibilities • Lead and have general authority and oversight over all legal matters involving MFA, including contractual matters, litigation, compliance and legal liability;
• Manage, recruitment, hire, and overall leadership of general counsel staff;
• Review and approve association comment letters to policymakers as well as all testimony and legal filings;
• Represent MFA before relevant domestic and international regulatory agencies and, as necessary, Congress;
• Provide MFA’s Board and relevant committees, as necessary, with briefings and updates on regulatory policies and priorities;
• Serve on MFA’s Leadership Team;
• Support the development and delivery of MFA conferences, seminars, forums and other events
• Establish high degree of coordination and collaboration with all MFA departments
• Optimize work flow processes and overall delegation/distribution of legal staff responsibilities
• Perform all other duties as directed by the President/CEO necessary for the professional discharge of association responsibilities.
A successful candidate will have earned a Juris Doctorate and a strong background (ideally 10+ years) with demonstrated record of legal excellence specifically in financial and trade industries; in depth knowledge of the structure and process of government and financial regulatory affairs; current understanding of relevant statutory provisions, supporting administrative processes and applicable standards of ethical conduct; experience leading and managing a legal team; ability to be a team player and lead the organization in maintaining a supportive and encouraging environment; a work style characterized by collegiality, collaboration, communication across teams; overall provision of innovative ideas and leadership. The ideal candidate will have excellent organizational capabilities and possess strong written and verbal communication skills.
